Is my client eligible for small business CGT concessions?

Your client can make a small business CGT contribution to their account if they’ve satisfied either or both of the following eligibility criteria:

  • small business 15-year exemption
  • small business retirement exemption

How much can my client contribute?

The specific small business CGT concessions place limits on the amount that can be contributed under these rules.

In addition, there's a lifetime CGT cap that limits the amount that can be contributed under these rules. Contributions made under both the small business 15-year exemption and retirement exemption count towards this limit.

When do the contributions need to be made by?

The contributions need to be received by the super fund no later than 28 days after the month the contributor turns 75. For instance, if they were to turn 75 on the 6th of May 2025, the contribution would need to be received by the 28th of June 2025.

Separate timeframes also apply. These timeframes are determined by the CGT concession the contribution is being made under and the type of entity that is claiming the CGT concession (e.g. individual, company or trust).

How does my client make a small business CGT concession contribution?

Your client can only make a small business CGT concession contribution into their Macquarie Wrap Super account using direct debit. We can’t accept small business CGT concession contributions via BPAY or direct credit.

Please complete the Direct debit request form and a Capital Gains Tax election form (NAT 71161) available at the ATO website and upload it to Request Centre in Adviser Online.

Important: We must receive the completed forms from you before we receive the contribution. If the contribution is received prior to the receipt of this form, the contribution cannot be classified as a small business CGT concession contribution by law.

How long does it take for a small business CGT concession contribution to be processed?

Once we process the direct debit, funds can take between 1-3 business days to arrive in the client's Super account.

The contribution is recorded as received and in effect from the day it is debited, as long as the payment clears.

To ensure the payment can be processed, make sure the account can be direct debited from.
