1. Introduction

Please read these Terms of Use carefully before you add a Macquarie Card for use in Apple Pay.

By adding a Macquarie Card for use in Apple Pay on your eligible Apple Device, or should an Additional Cardholder add a Macquarie Card to their eligible Apple Device, you are taken to agree to these Terms of Use. They operate in addition to, and should be read together with any Account Terms and Conditions.

Other than with respect to section 11 (Definitions), if there are any inconsistencies between these Terms of Use and any Account Terms and Conditions, these Terms of Use will apply.

2. Apple Pay provided by Apple

Apple Pay is a service provided by Apple. You will also need to agree to Apple's Terms and Conditions in order to use Apple Pay (in addition to agreeing to these Terms of Use).

Macquarie is not responsible for the use, functionality or availability of Apple Pay, any eligible Apple Device, or the availability of contactless readers at merchants.

3. Using Apple Pay

A Macquarie Card can only be registered for use in Apple Pay if:

  • we can verify your or the Additional Cardholder's identity (as applicable); and
  • in the case of joint account holders, each account holder has agreed to the Macquarie Card being added to the relevant cardholder's eligible Apple Device.

A Macquarie Card can be removed from Apple Pay at any time by the person who added it to Apple Pay.

You can use your Apple Device to make a payment using Apple Pay in stores (where contactless readers are available) or within apps or participating websites (where the Apple Pay button is displayed). Further information about adding, using and managing your Macquarie Card within Apple Pay can be accessed in the Help Centre.

4. Fees and charges

Macquarie does not charge you establishment or on-going fees for using a Macquarie Card with Apple Pay. The Account Terms and Conditions outline the fees and charges (including any transaction fees) which apply to each relevant account. You are responsible for all third party charges associated with the use of Apple Pay including network data charges.

5. Security

Any person who can unlock your Apple Device or that of an Additional Cardholder may be able to make transactions using the Macquarie Card registered in Apple Pay.

If a Macquarie Card is registered for Apple Pay on a cardholder's eligible Apple Device, you are responsible for ensuring that:

  • the Apple Device Passcode is set by the relevant cardholder (which may include you) and not by any other person;
  • the Apple Device Passcode is kept secret, secure and is not shared with anyone else;
  • only the relevant cardholder's fingerprint can unlock the Apple Device;
  • Apple Pay is only used by the relevant cardholder; and
  • the relevant cardholder follows Macquarie's security guidelines (outlined in section 11 of the Macquarie Electronic Banking Terms and Conditions) to protect their Apple Device Passcode and assist in preventing unauthorised transactions.

If a cardholder shares or permits any other person to use their Apple Device Passcode or any other Secret Code, they are taken to have authorised that third person to transact on your account using Apple Pay. You are responsible for any such transactions, and section 6 (liability for unauthorised transactions) in these Terms of Use does not apply.

Reporting loss, theft or misuse of Secret Codes or your Apple Device

You or an Additional Cardholder (as relevant) must notify us immediately if it is suspected that the security of an Apple Device Passcode, other Secret Code or Apple Pay has been breached.

We can be contacted 24 hours, 7 days a week, by calling us on:

6. Liability for unauthorised transactions

The Macquarie Electronic Banking Terms and Conditions deal with liability for unauthorised transactions (refer to section 10). Generally, you are liable for unauthorised transactions, subject to the protections in the ePayments Code as outlined in these Terms of Use.

  • each reference to 'Electronic Banking' includes accessing your account via Apple Pay.
  • each reference to 'Secret Code' includes reference to your Apple Device Passcode.

7. Suspension and termination of Apple Pay

Macquarie may, acting reasonably and, if possible, with reasonable notice, block, suspend or terminate your Macquarie Card in Apple Pay for any of the following reasons:

  • fraud or suspected fraud;
  • if your Macquarie Card is cancelled, blocked or suspended;
  • you are in default under your Account Terms and Conditions;
  • a breach or suspected breach of these Terms of Use, your Account Terms and Conditions and any other incorporated agreements or guidelines;
  • to comply with our obligations under any applicable laws (including any Anti-Money Laundering or Counter-Terrorism Financing laws and sanctions laws) or a court order;
  • requests by law enforcement or other government agencies;
  • if directed to do so by Apple and/or the applicable card network (for example, in circumstances of suspected fraud);
  • Macquarie's arrangements with Apple and/or a relevant card network regarding Apple Pay cease or are suspended;
  • if the relevant Apple Device is lost, misplaced or stolen; or
  • to protect the security of your account.

8. Privacy

We will collect, use and share your information (including personal information) in accordance with the Macquarie Group Privacy Policy. This will include Macquarie collecting information from Apple to verify you, to ensure your Macquarie Card functions with Apple Pay, to manage fraud, or for Macquarie to provide better assistance to you.

To facilitate your participation in Apple Pay, we will disclose certain information to Apple (including your personal information) relating to a Macquarie Card you have registered for use in Apple Pay. Apple may use this information to display your transaction history in Apple Pay, detect and address fraud, or otherwise use the information in accordance with Apple's Privacy Policy.

If you do not want your information to be collected, disclosed, shared or used as described, a Macquarie Card should not be registered for use in Apple Pay.

9. Changes to Terms of Use

Provided that we act reasonably, we may change these Terms of Use at any time, and we will notify you as required by law. We will only do so to manage the consequences of changes to our business or systems, changes to laws, if required by courts or regulators, to address security issues or to make the Terms of Use clearer. Except where otherwise required by law, you agree that our publishing of an amended version of these Terms of Use will be sufficient notice of any changes, and your subsequent use of a Macquarie Card in Apple Pay will constitute acceptance of those amendments.

Communicating with you

If notification is required or we need to get in contact with you, you agree that we may communicate with you electronically by sending you an SMS to your Apple Device, an email to the email address that you have provided to us or by any other means as permitted by law.

10. Severability

If any provision or part of provision of these Terms of Use is illegal, invalid or unenforceable, it will be severed from these terms and the remaining provisions (or part thereof) will continue in full force and effect.
