1. Introduction

Please read these Terms of Use carefully before you add a Macquarie Card for use in Apple Pay.

By adding a Macquarie Card for use in Apple Pay on your eligible Apple Device, or should an Additional Cardholder add a Macquarie Card to their eligible Apple Device, you are taken to agree to these Terms of Use.

These Terms of Use operate in addition to, and should be read together with, the Electronic Banking Terms and Conditions (EB T&Cs), available at www.macquarie.com.au/digital-banking/electronic-banking-terms-and-conditions.html, and any Account Terms and Conditions. By agreeing to these Terms of Use you also acknowledge having read and agreed to the EB T&Cs.

Other than with respect to section 11 (Definitions), if there are any inconsistencies between these Terms of Use, the EB T&Cs and any Account Terms and Conditions, these Terms of Use will apply.

2. Apple Pay provided by Apple

Apple Pay is a service provided by Apple. You will also need to agree to Apple's Terms and Conditions in order to use Apple Pay (in addition to agreeing to these Terms of Use).

The use, functionality or availability of Apple Pay, any eligible Apple Device, the availability of contactless readers at merchants, and the terms governing the use of Apple Pay is a matter between you and Apple and Macquarie has no responsibility for anything associated with these services.

In the event of inconsistency between these Terms of Use and Apple's Terms and Conditions, these Terms of Use will govern the relationship between you and Macquarie, and Apple's Terms and Conditions will govern the relationship between you and Apple.

3. Using Apple Pay

A Macquarie Card can only be registered for use in Apple Pay if:

  • we can verify your or the Additional Cardholder's identity (as applicable); and
  • in the case of joint account holders, each account holder has agreed to the Macquarie Card being added to the relevant cardholder's eligible Apple Device.

A Macquarie Card can be removed from Apple Pay at any time by the person who added it to Apple Pay.

You can use your Apple Device to make a payment using Apple Pay in stores (where contactless readers are available) or within apps or participating websites (where the Apple Pay button is displayed). 4. Fees and charges

Macquarie does not charge you establishment or on-going fees for using a Macquarie Card with Apple Pay. The Account Terms and Conditions outline the fees and charges (including any transaction fees) which apply to each relevant account. You are responsible for all third party charges associated with the use of Apple Pay including network data charges.

5. Security

Any person who can unlock your Apple Device or that of an Additional Cardholder may be able to make transactions using the Macquarie Card registered in Apple Pay.

If a Macquarie Card is registered for Apple Pay on a cardholder's eligible Apple Device, you are responsible for ensuring that:

If a cardholder shares or permits any other person to use their Apple Device Passcode or any other Secret Code, they are taken to have authorised that third person to transact on your account using Apple Pay and you may be responsible for any such transactions – see the EB T&Cs for further information regarding liability for unauthorised transactions.

Reporting loss, theft or misuse of Secret Codes or your Apple Device

In accordance with the EB T&Cs, you or an Additional Cardholder (as relevant) must notify us as soon as you become aware of any security compromise.

6. Liability for unauthorised transactions

The EB T&Cs sets out liability for unauthorised transactions which is in accordance with the ePayments Code (where it applies).

As a reminder, making payments via Device is a relevant ‘Access Method’ and constitutes payment by a ‘Payment Card’ under the EB T&Cs, and all relevant provisions apply.

7. Suspension and termination of Apple Pay

Macquarie may block, suspend or terminate your Macquarie Card in Apple Pay for any of the reasons stated in the EB T&Cs or the Account Terms and Conditions.

8. Privacy

In addition to the privacy provisions and disclosures within the Account Terms and Conditions, we may collect information from Apple to verify you, to ensure your Macquarie Card functions with Apple Pay, to manage fraud, or so we can provide better assistance to you.

To facilitate your participation in Apple Pay, we will disclose certain information to Apple (including your personal information) relating to a Macquarie Card you have registered for use in Apple Pay, but only insofar as such information is needed by Apple. Apple may use this information to display your transaction history in Apple Pay, detect and address fraud, or otherwise use the information in accordance with Apple's Privacy Policy.

If you do not want your information to be collected, disclosed, shared or used as described, a Macquarie Card should not be registered for use in Apple Pay.

9. Changes to Terms of Use

We may change these Terms of Use at any time:

  • so long as we act reasonably, and
  • in accordance with the law and any codes of conduct to which we subscribe.

We will notify you of any such changes alongside any changes to the EB T&Cs, and/or we may request your agreement to any revised Terms of Use. If you are not satisfied with any change or variation to these Terms of Use, you may choose to deactivate and cease using Apple Pay without cost.

10. Severability

If any provision or part of provision of these Terms of Use is illegal, invalid or unenforceable, it will be severed from these terms and the remaining provisions (or part thereof) will continue in full force and effect.

11. Definitions

Account Terms and Conditions means the terms and conditions that apply to the use of a Macquarie Card and/or any account with us which may be accessed using a Macquarie Card.

Additional Cardholder means a person to whom we have issued a Macquarie Card and whom you have authorised to access or transact on an account you have with us, using the Macquarie Card.

Apple means Apple Pty Limited ABN 46 002 510 054, having a principal place of business at Level 2, 20 Martin Place, Sydney NSW 2000 and/or its related bodies corporate and affiliates.

Apple Device means an iOS device (including an iPhone, iPad or Mac computer) or Apple watch manufactured by Apple which is able to be used to register Macquarie Cards in Apple Pay. For a list of compatible Apple Pay devices, see https://support.apple.com/km207105

Apple Device Passcode means a passcode or any other security mechanism that is used to unlock your Apple Device.

Macquarie, we or us means Macquarie Bank Limited ABN 46 008 583 542, AFSL and Australian Credit Licence 237502

Macquarie Card means a credit or debit card issued by us which is not expired, blocked, suspended, closed or cancelled.

Macquarie Electronic Banking Terms and Conditions or EB T&Cs means the terms and conditions available on the Macquarie website.

You means the holder(s) of an account to which a Macquarie Card has access and, as the context requires, means a holder of such Macquarie Card (including an Additional Cardholder).

Apple, the Apple logo, Apple Pay, Apple Watch, iPad, iPhone, Mac, Safari and Touch ID are trademarks of Apple Inc., registered in the US and other countries.
